$16.25 Million Elder Abuse Settlement with Aegis Senior Communities

Residents of assisted living facilities operated by Aegis Senior Communities LLC (Aegis) will share in a settlement fund of $16.25 million awarded as part of a class action settlement approved by the United States District Court for the Northern District of California on August 23, 2021.  The case, in which Schneider Wallace partner Guy Wallace is co-lead Class Counsel, is Newirth  v. Aegis Senior Communities, Inc., Case No. 16-cc-03991-JSW.  The settlement resolves a class action lawsuit against the company In which the residents alleged that the assisted living facility deceived  potential residents about the provision of care services to  residents and whether there was sufficient staff to provide such care, violating elder abuse and consumer protection laws.

The deal would award settlement funds to residents of Aegis Senior Communities in California and Washington. Aegis Senior Communities does business in California and Washington as Aegis Living, the settlement is approved would resolve lawsuits pending in both states. The California lawsuit sought the recovery of community fees paid by residents based on the alleged misrepresentations made by Aegis, pursuant to the California Consumers Legal Remedies Act and the Financial Elder Abuse statute. The settlement also includes  a three-year injunction for Aegis, under  which the company is required to provide  appropriate staffing and resources for residents.

Legal complaints in elder abuse cases have frequently involved how facilities charge more based on individual resident needs (a resident who needs more care will be charged more) but then fail to adjust staffing based on this additional care. Elderly care facilities that do not use the assessments to ensure proper staffing levels are failing to care properly for residents and consumers.
