Acosta Merchandiser Class Action Lawsuit
 

Employment Lawyers File Class and Collective Action Lawsuit Against Acosta Sales & Marketing Co.


On March 2, 2011, Schneider Wallace Cottrell  Konecky LLP filed a class and collective action lawsuit on behalf of Acosta Merchandisers in California and throughout the United States. The lawsuit alleges that Acosta requires Merchandisers to work off-the-clock at home and outside their store calls without the legally required compensation.  The lawsuit also alleges that Acosta's mileage and automobile reimbursement rates are unlawfully low and that Acosta fails to reimburse Merchandisers for other required employment expenses, such as cell phone, high speed internet expenses, printers, facsimiles, scanners, paper, and other tools and equipment.  The lawsuit alleges that Acosta's policies and practices violate state and federal employment laws.


The lawsuit was filed in federal court in Los Angeles and seeks compensation for employees affected, specifically for unpaid overtime and wages, as well as reimbursement of all employment-related expenses. 


Acosta Class and Collective Action Lawsuit Case Update


We are pleased to announce that the federal court recently certified the case as a collective action, which means that each eligible Merchandiser will be sent a notice describing the lawsuit and will be provided an opportunity to "opt-in" or participate in the case by submitting a "Consent to Join' form.  The Notice and the Consent to Join form will be sent to eligible merchandisers on or about February 10, 2012. How do I join the Acosta Unpaid Overtime & Employee Expenses Class Action Lawsuit?


Acosta Merchandisers who are interested in participating in the lawsuit must sign and submit a Consent to Join form by April 20, 2012, to "opt-in" to the case.
