Employment Discrimination

EEOC Complaint Process

The U.S. Equal Employment Opportunity Commission (EEOC) hears complaints on the federal level. Upon reviewing the charge, the EEOC may encourage the parties to settle the claim through mediation. If mediation is not appropriate or does not resolve the issue, the EEOC assigns the claim to an investigator. At the conclusion of the investigation, the EEOC may attempt to facilitate a voluntary settlement, file a lawsuit against the employer or issue a Notice of Right to Sue, which allows our client to file a lawsuit in federal court.

Filing an Employment Discrimination Complaint in California

The California Department of Fair Employment and Housing (DFEH) handles state level employment discrimination complaints. Upon accepting our client’s Pre-Complaint Inquiry, the DFEH conducts a full investigation. Parties are permitted to voluntarily enter DFEH-facilitated mediation before the agency issues its determination. 

Filing an Employment Discrimination Complaint in Arizona

The Civil Rights Division of the Office of the Arizona Attorney General processes state discrimination complaints. The Arizona Attorney General has both administrative and enforcement functions, giving the agency authority to investigate the claim and process the complaint. The agency offers mediation services and may pursue employers in state court.

Filing an Employment Discrimination Complaint in Texas

The Texas Workforce Commission’s Civil Rights Division (TWC) is responsible for investigating discrimination complaints in the state and enforcing the Texas Labor Code. Upon submitting the claim, the TWC invites the parties to mediation. In some cases, we may recommend declining mediation, in which case the TWC assigns the claim to its investigator.
