Employment discrimination can take many forms. You may face
employment discrimination in hiring because you’re female, or dismissed
without cause, or just because you’re over the age of 40. It is important
to recognize that employment discrimination is not only unethical—it’s also
against the law.
It is important to note what kinds of
practices are banned by employment discrimination laws. Such laws involving
discrimination in employment govern hiring and firing; classification of
employees; promotions, transfers, and layoffs; job advertisements,
recruitment and testing; pay, fringe benefits, and retirement plans; and
other terms and conditions of employment.
Specifically, the 5th and 14th
amendments to U.S. Constitution law restrict the power of federal and state
governments to discriminate with regards to employment. Under the law of
the 5th amendment, the federal government cannot deprive
individuals of life, liberty, or property without due process of law, which
can also be seen as a protection against employment discrimination.
Meanwhile, the 14th amendment bars states from violating an
individual’s rights to due process and equal protection—another instance in
which employment discrimination would be prohibited by law. Thus, there is
a definite constitutional basis for employment discrimination law.
