Mr. McKay represents plaintiffs in complex commercial disputes and class actions.  His experience includes litigating securities claims, consumer fraud claims, antitrust allegations, racketeering claims and business torts.

He recently represented an Arizona city bringing claims against a Fortune 500 company.  The city settled its claims for approximately $15 million.  He currently represents the City of Phoenix in a multi-million dollar lawsuit against insurance companies who are alleged to have unlawfully overcharged Phoenix for bond insurance. 

Mr. McKay, along with other lawyers, represented a nationwide class in In re Conseco Life Ins. Co. Cost of Ins. Litig., MDL No. 1610 AHM (C.D. Cal.), which settled for over $400 million.  He represented a nationwide class in In re Ins. Brokerage Antitrust Litig., MDL No. 1663 GEB (D. New Jersey), which settled for over $121 million. 

He is currently one of the lawyers representing consumers across the country whose homes were built with allegedly defective Kitec plumbing systems.  As alleged in the complaints in those cases, Kitec plumbing systems are subject to failure because brass fittings used to connect pipe are prone to dezincification, which restricts water flow and causes pipes to leak resulting in water damage.  He is also currently pursuing claims on behalf of consumers who have been victims of alleged unfair and unlawful medical billing practices. 

Mr. McKay is admitted to practice before the U.S. Supreme Court, Ninth Circuit Court of Appeals, U.S. District Court, District of Arizona, U.S. District Court, District of Colorado, and the Arizona Supreme Court.  Prior to joining Schneider Wallace, he served as a law clerk for The Honorable Gordon J. Low, Utah First District Court, and as a law clerk for the United States Attorney’s Office, N.D.N.Y.  He graduated with honors from Syracuse University College of Law.
