It is against the law for employment bias to occur on the basis of race, sex, religion, national origin, physical disability, or age.

 

Under the law, employment discrimination refers to bias in hiring, promotion, job assignment, wrongful termination, compensation, and different forms of harassment.  The body of these laws consists of federal and state statutes, although the U.S. Constitution and various state constitutions also provide some protection against bias in employment.

Employment discrimination law took a quantum leap forward with the passage of the Civil Rights Act of 1964.  The law applies to employers with more than 15 employees, and prohibits bias based on race, color, religion, sex, or national origin.  This discrimination law also specifically makes it illegal for employers to discriminate in various aspects of employment, including hiring, firing, and compensation.

 

In addition, the American with Disabilities Act is a landmark employment discrimination law.  The ADA prohibits bias in employment against those with physical or mental handicaps.  This law ensures that people with disabilities will be treated fairly as they attempt to seek gainful employment.
