Arbitrator Awards $447,894 To Former PeopleSoft Employee Terminated Because of Her Pregnancy

An award of $447,894 was made by the Hon. Ellen James (Ret.) of JAMS following the arbitration held in the matter of Sarah Deigert v. PeopleSoft, Inc.

San Francisco, CA (PRWEB) May 20, 2004–-An award of $447,894 was made by the Hon. Ellen James (Ret.) of JAMS following the arbitration held in the matter of Sarah Deigert v. PeopleSoft, Inc.

The plaintiff worked for defendant as a Business Development Executive. In early 2001, the plaintiff became pregnant and subsequently went on pregnancy leave in May 2001. While on pregnancy leave and only ten days after giving birth to her child, the defendant terminated her employment, stating that her position had been eliminated.

The arbitrator found that the plaintiff’s position had not been eliminated and that another employee had been hired to perform the plaintiff’s position. The arbitrator found that Ms. Deigert’s pregnancy was the motivating factor for her termination.

Todd M. Schneider, one of Ms. Deigert’s attorneys said “this award will send a message to all employers that they cannot violate the rights of pregnant women”

Clint J. Brayton said “California’s civil rights laws were designed to prevent employers from retaliating against working women who want a family.”

Sarah Deigert said “I am proud of myself for standing up to PeopleSoft. I hope that all women who are victims of pregnancy discrimination will take strength from this verdict.”
